To win this round, Sony just need to do the same as Nintendo and say "We will not in any way prevent you from trading your games once you have bought them"
Used games do indeed drive new game sales, so even if the original publishers dont usually see a second profit (I know of at least one online trade site that attempts to pay royalties to the original publishers) from used games, they benefit from peoples money being freed up to spend on new games they would otherwise not buy.
As a classic game fan, I really hope this stupid idea fails and drops Microsoft down a peg or two in the process or gone will be the days of buying a handfull of games from a carboot/yard sale in the future.
