If I were nestle I would just tell them "F*** Off". You can't copywrite a game concept. Just because they're playing a breakout style game, doesn't mean that they are playing atari's breakout game.

Nestle/KitKat will be OK as they can use the "parody" law as protection as well as fair use - both here in the uk/Europe - https://www.bbc.co.uk/news/entertainment-arts-29408121 and in the US.
