I really don't understand how they can justify keeping him in jail for so long, at tax payers expense, when a bullet costs mere pennies. America is the land of the gun. Or is it only OK to use it on innocents?

That's the whole point. He was sentenced to death but wasn't put to death. He was kept alive for 40 years, when the cost of any form of penalty by death - lethal injection, gas, electric, hanging costs virtually nothing in comparison, and they should have done that 40 years ago.
