AL's Copyright Claim

Oh 'eck!!

Over on SoundCloud, AL's latest choon (Variable Beast) got itself a copyright claim, and has been removed from listenability!

I can only say that any and all ALChoons are created as is, and the only thing that sparks my imagination is either a random melody in my head, or the "vibes" I get from experimenting with different instruments.
Other than my three AL-Style cover albums, I very rarely do remixes or the like.

And yet this one must've got FAR too close to someone else's track.

That someone, N-Drew, claims that I stole his track "Gravity Waves", but annoyingly as much as I've hunted, I can't find it.
I can find Gravity Waves 2 on SoundCloud, and .. That sounds NOTHING like it, so I can only assume the original must be quite different.
If you can find the original, please do let me know where, so I can hear JUST how close I managed to get to his track.

FWIW : I have no idea who this N-Drew is, and as much as I create twiddly synthy "dance" tracks (!?!), I very rarely listen to such music. As you all know, I happen to listen to a ton of JPop..

-=-=-

I'm going to leave it there. It's not worth fighting.
If anyone asks "Do you have proof you created it?" the only proof I have is that I have an ableton file, not how I put it together, or why I chose the notes that I did. It's a very very difficult thing to argue, and .. honestly, it's just not worth it.
I'm spitting out music willy nilly, and I definitely couldn't afford to fight any such claim.
Fuck it.

Now I'm interested.... I didn't catch your tune to hear what that sounds like, but also, no idea what the other sounds like.

How can somone make a copyright claim when the so called 'original' is nowhere to be found? Surely that fact alone backs up the fact that it wasn't plagerised?

It's fucking annoying, isn't it? Anyone can say you stole their tune without a single shred of proof and without allowing you to hear their alleged tune (which may or may not even exist). Fuckwads - claimant and Soundcloud for accepting the allegation without discussion with both parties.

The Mod Archive has a track called "Gravity Waves" - http://modarchive.org/index.php?request=view_by_moduleid&query=43354

I've no idea if this is the track referenced or if it sounds like yours, as -

a) I've not downloaded it
b) I never heard your track

Thought I should look into some stats.
Definitely a fraudulent claim, unless "The person who I copied" just happened to be the only person to have listened to the track.
This shit's really obvious when nobody listens to your music.

Surely you can contest it simply by saying "There is no original for my tune to be copied from"...?

In order to contest a claim you first need to give your home address and phone number to SoundCloud, who then pass that to the person making the copyright claim.

I don't know how Sound cloud works, but YouTube will digitally scan your uploads and using some secret hidden algorithm, determine if you have violated copyright. Videos constantly get banned because of false positives. The actual copyright holder isn't even part of the process. There is one person who had a video banned for using music that he created himself.

You can contest it, and then YouTube and the copyright holder will review it, and if it is determined that there is no copyright violation, then the video is re-released.

My guess is that Sound cloud has a similar algorithm it uses and your song was caught up in it. Just contest it, then an actual human will be forced to review it.

I won't be bothering, like I say it's not worth it, no bugger listens to my music, anyway.. Less than 10 plays a week usually!
Those that do want to listen to my music usually use the AGameAWeek Jukebox.
And it won't be shifting from there without more substantial proof.

Doesn't sound like a great system if they are wiping their hands of it and giving your details to this unknown person raising false claims!

I don't blame you, and if you were at all bothered I'm sure there are alternative sites to publish on?

I'm pretty sure that they would be breaking international privacy laws by giving him any of your private/personal data. I would question their knowledge of the Data Protetion Act and GDPR. They are the one's upholding the allegation by removing your tune, so they are the ones that need to prove that you stole it, if not it should be reinstated. I'd fight it, you have absolutely nothing to lose.

Yeah... I just don't have the energy, right now, if I'm completely honest.

Jay, assign your copyrights to my Ltd Company (that only really exists for payroll, tax, trade mark, insurance, and admin purposes) under a 100% royalties-to-Jay contract that you can revoke at any time and I will contest the claim with my office address so hard > : - ( no biggie

aside: SoCoder is such a positive place that I just noticed we don't have an angry emoticon

aside to the aside: gawd remember when they were called emoticons instead of emojis. I didn't even have the muscle memory to type emoticon!!!

Ooooh!

I did not know that, but I also do not know how to type an emoji from desktop

Did you have to program anything special to support that?

(now wishing SoCoder was open source so I could peek!!)

Nope, the site just supports unicode, so emoji comes as standard, as well as possibly the odd security hole if you care to dig..
... Don't dig, please

There's a shortcut on windows to bring up a dialogue for it.. Winkey+. or something around there.. Can't remember for sure.

|edit| Yeah, Windows' Emoji support kinda sucks! |edit|

They are going after Taylor Swift right now. She or her team used a couple of lines that someone else used before.
Today I was reading she is again being sued for having a image in her album that looks similar to another image. You can not use the same color scheme and draw something that looks a little bit like something else?

Ai art is Apearantly non copyrightable. They are stil suing in higher courts. The first results was that art needs to de drawn by humans. No idea how much needs to be drawn by humans though.
